The MDU website (Website)

These terms and conditions (Terms) govern your use of the Website. Please read through the Terms. If you do not agree with the Terms do not use the Website. If you do use the Website your conduct indicates that you agree to be bound by the Terms.

  1. Copyright notices
    1. Except as otherwise noted, all items that appear within the Website are the copyright of The Medical Defence Union Ltd and/or MDU Services Limited (the MDU) 2008 including the design, text, graphics and arrangement of the items.
    2. You may retrieve and display the materials on the Website (Content) on a computer screen and print individual pages on paper and store such pages in electronic form on a disc for your personal non-commercial use but not on any server or other storage device connected to a network.
    3. Except as expressly set out in this clause you may not reproduce, modify, store, archive or in any way commercially exploit any of the material on the Website. In particular you may not do any of the following without the prior written consent of the MDU:
      1. redistribute any of the material from the Website; or
      2. remove the copyright or trademark notice from any copies of the material made under these Terms.

  2. Regulatory and legal information
    1. MDU Services Limited (MDUSL) is authorised and regulated by the Financial Services Authority in respect of insurance mediation activities only. MDUSL is entered in the Financial Services Authority's Register, register number 312054. You can check MDUSL's registration on the FSA register or by contacting the FSA on 0845 606 1234.
    2. MDUSL is an agent for The Medical Defence Union Limited (the MDU).
    3. The MDU is not an insurance company. The benefits of membership of the MDU are all discretionary and are subject to the Memorandum and Articles of Association.
    4. The Dental Defence Union is the specialist dental division of The Medical Defence Union Limited and references to the DDU and DDU membership mean the MDU and membership of the MDU.
    5. MDU Services Limited is registered in England 3957086. Registered Office: 230 Blackfriars Road London SE1 8PJ.

  3. General disclaimer
    1. Whilst every effort has been made to ensure the high quality and accuracy of the Website, the MDU is providing the Website on an "AS IS, AS AVAILABLE" "WITH ALL FAULTS" basis to users. You use the Website at your own risk. The MDU does not give any warranties in respect of Content, software or services available through the Website. All conditions, representations and warranties (express or implied, statutory or otherwise) are excluded to the extent permitted by law including without limitation any implied warranties or conditions as to quality, fitness for purpose and reasonable skill and care.
    2. Additionally the MDU makes no warranty that the Website is free from infection by viruses or anything else that has contaminating or destructive properties and disclaims liability for any losses or damage so ensuing.
    3. The Content may contain technical inaccuracies and typographical errors. The Content may be updated from time to time and may at times be out of date. The MDU accepts no responsibility for keeping the Content up to date or liability for any failure to do so.
    4. The MDU does not endorse or make any representation about any of the general practitioners, dentists, hospitals, surgeries, companies, products or services of third parties found on the Website.
    5. The medico-legal and ethical information contained on the Website is for general information only. This does not constitute medico-legal or ethical advice and you should take appropriate professional advice and not rely on it to make (or refrain from making) any decision or take (or refrain from taking) any action.
  4. Third parties and external websites
    1. The Website contains material submitted and created by third parties. The MDU excludes all liability for any illegality arising from or error, omission or inaccuracy in such material.
    2. You may access third party websites through links contained on the Website. Such third party websites are not under the control of the MDU and the MDU is not responsible for the availability of such websites or their content. Any links provided on the Website are provided for your interest or convenience only and do not represent or imply any endorsement of such linked websites by the MDU. You acknowledge that use of such third party websites is governed by the terms and conditions of use as applicable to such Website.
    3. You may place a link from your website to the Website provided you follow the following guidelines:
      1. not to replicate the Content;
      2. not to create a frame or border environment around the Content;
      3. not in any way imply that the MDU is endorsing your website or its products or services;
      4. not present false information about the MDU;
      5. not use any of the MDU's trademarks without prior written consent of the MDU;
      6. ensure your website does not include content which would be construed as distasteful, controversial or offensive;
      7. ensure your website does not infringe any intellectual property or other rights of any third parties;
    4. The MDU expressly reserves the right to request that any link in breach of these Terms be removed and to take whatever other action it deems appropriate.
  5. Advertising and sponsorship
    1. Part of the Website may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that materials submitted for inclusion on the Website comply with international and national law. The MDU is not liable for any error or inaccuracy in advertising material.
  6. Privacy statement
    1. This Privacy Statement explains our data processing practices relating to your personal data collected through this website. If you have any requests concerning your personal information (Personal Data) or any queries about this website, please contact us by email at website@the-mdu.com
    2. Any Personal Data we collect from the Website will be used in accordance with the Data Protection Act 1998 and other applicable laws.
    3. Personal Data (name, address, email address etc) is collected when you register on the site and also when you complete one of our online forms.
    4. The MDU uses Personal Data collected via the website to update our membership records, for marketing purposes (such as providing you with medico-legal updates or details of products and services that we think will be of interest to you) and for the processing of any payments made by you through this website. If you object to our processing your Personal Data in this way, you may at any time ask us to stop, either by e-mailing website@the-mdu.com or writing to: The MDU Marketing Department, 230 Blackfriars Road, London SE1 8PJ. Members have the right to apply for a copy of their personal data collected via the website (for which the MDU may make a small charge) and to have any inaccuracies corrected.
    5. We will keep a record of any orders you make through the site (eg a book order). We will not retain any of your credit/debit card details however these details may be retained by third parties who we ask to process payments on our behalf..
    6. Unless otherwise stated, we will NOT pass your Personal Data to any third party for marketing purposes.
    7. The privacy statement does not apply to third party sites.
  7. Use of cookies on our site
    1. A cookie is a small amount of data which we send to your computer. The data is then stored on your browser or hard disk so that the Website can remember who you are and help with navigation around the site.
    2. The MDU uses two types of cookies on this Website. Session cookies which are temporary cookies that remain in the cookie file of your browser until you leave the site and Persistent cookies which are stored on your hard disk for longer.
    3. The MDU uses cookies for the following reasons:
      1. To remember your chosen area of interest (eg GP, Hospital), so when you revisit the Website you are automatically returned to that part of the site (Persistent cookie)
      2. To control log-in and allow access to restricted "member-only" articles on the Website (Session cookie)
      3. To enable the automatic log-in feature if you chose this at the time of registration (Persistent cookie)
      4. To ensure you are not asked to complete a questionnaire that you have already completed or one that you indicated you did not wish to complete (Persistent cookie)
      5. To count anonymously the number of new and repeat visitors to the Website (Persistent cookie)
    4. You can delete cookies from your hard disk at any time. You also have the ability to accept or decline cookies by modifying the settings in your browser. If you do this however you will not be able to use all of the features of this Website such as access to restricted "member-only" articles.   8. Security
    1. Our site uses 128bit encryption. Your browser will go into secure mode on any form where you are required to input your credit/debit card or bank account details. This means that all your details are encrypted and transmitted securely to us, DataCash or Worldpay (see 2. below). You can check if you are in a secure environment by looking for either a locked padlock icon or key in the grey bar at the bottom of your browser.
    2. We use a third party provider, Worldpay Limited (registered number 3424752) part of the Royal Bank of Scotland Group (Worldpay), for the processing of payments through this website. Worldpay has its own systems in place to ensure the security of data received and processed by it.     3. We use a third party provider, DataCash Limited (registered number 3430157) (DataCash) for the processing of online subscription payments through this website.
  9. Online purchase
    1. Credit or debit card details are used for processing payment only. We use Worldpay for the processing of payments received through this website. Please see paragraph H. above
    2. When you place an order with us you will receive an automatic confirmation email. Your order represents an offer to us to purchase: a product which is accepted by us when we send an email confirmation to you of the dispatch of such product; or a course which is accepted by us when we send you the enrolment confirmation.
    3. While all reasonable care is taken to protect the confidentiality of your card and personal details, the MDU cannot be held liable if, through no fault of our own, these details are intercepted and used by an unauthorised third party.
    4. The MDU will provide a refund on all MDU courses up to thirty days before the date of the course. If you take delivery of a product which is damaged, defective or incorrect you can return the item(s) to us within 30 days of receipt for exchange. Please note that you will be responsible for the cost of returning the items unless we delivered the item to you in error, or if the item is damaged or defective. Customers in the European Union also have a right to withdraw from the purchase of an item within 7 working days of the day of order. This right of withdrawal applies to all products except courses which have been booked within 7 days of the course date. If you need to cancel, return or replace a product or cancel a course booking, for whatever reason, you should first contact us. For your protection we recommend that you use a recorded delivery service when returning items to us.
    5. All prices include VAT (where applicable). Unless otherwise stated there are no delivery charges.
    6. The contract is in English and communication between us will be in English. Nothing in this paragraph is intended to affect your statutory rights.
  10. Online subscription payments
    1. Online renewals and online outstanding balance payments may be requested by existing UK members only. Such renewals or outstanding balance payments, if accepted, will be made on the terms set out in the UK member’s Annual Renewal Information document and other documentation included in his/her renewal pack which will be sent to him/her before his/her renewal date.
    2. UK members may only use the online renewal or online outstanding balance payment services if there has been no change to their work details as shown in that UK member’s most recent renewal letter or letter setting out the outstanding balance owed. Any failure by a UK member to report changes of work details to the MDU may affect his/her entitlement to the benefits of membership and to the insurance cover. Any changes in work details can be notified to us by calling our helpline on 0800 716376.
    3. The online credit/debit service offered by the MDU may only be used by members to pay the entirety of their outstanding balance owing. No part payments can be made online.
    4. When a UK member uses an online subscription payment service on this website (whether to request an online renewal or payment online of an outstanding balance payment), if his/her request is successful he/she will arrive at a “Success” web page and will receive a confirmation email. In the case of all three online subscription payment services (setting up an annual direct debt, requesting a monthly instalment agreement and credit/debt card payment) successful completion by a UK member of the online process will be treated as an offer to us to renew and/or to make payment (referred to us on the website as “a request for renewal” or “a request to make payment”). This will only be accepted by the MDU and become effective at such time as we confirm the same in writing to the applying UK member. The receipt of an automatic confirmation email or arrival at a “Success” web page does not constitute valid acceptance by the MDU.
    5. Where a UK member uses an online subscription payment service on this website (whether to request an online renewal or payment online of an outstanding balance payment), if his/her request is not successful any money that has been taken will be refunded within 30 days of the request not being accepted.

    1. These Terms will be governed and construed in accordance with English Law
  12. Third party offers and promotions
    1. The MDU always seeks to offer attractive benefits as part of membership and, as such, from time to time, may add, withdraw or amend benefits at its discretion.
